Family Law Masters Program Holds a Seminar entitled “Harmonization of Islamic Law and National Law in Family Law in Indonesia”

National Seminar of Master of Family Law Study Program

Exactly on July 21, 2022, located at the Shakti Hotel on Jalan Soekarno-Hatta, Bandung City, a national-based seminar was held starting at 08.00 until it was finished. The Family Law Study Program has the theme “Harmonization of Islamic Law and National Law in Family Law in Indonesia” which involves the ranks of the Study Program, Hombase Lecturers, and Students. This event was very conducive and inspiring for academics, especially in family law expertise.

Series of events

Opening

The series of opening events, beginning with the MC’s presentation at the opening of this event and continued with the chanting of the Holy Quran by one of the outstanding students of Family Law, followed by singing the Indonesian national anthem as a tribute to this beloved country. Furthermore, the presentation of the speech as well as the report by the Head of Study Program as the organizer of this event, Dr. Nurrohman, M.Ag and then the delivery of remarks by the Director of Postgraduate, Prof. Dr. Supiana, M.Ag CHSEE at the same time opened this event.

Question and answer session

After the delivery of the material has been completed, it is followed by a discussion or question and answer session. This session took place conducively starting from the seminar participants who asked questions and responses to the material that had been previously presented, as well as responses and answers from the presenters, this discussion procession was a form of ending the national seminar which was then closed by the presenters and the MC.

Harmonization of Islamic Law and National Law

According to Prof. Dr. Rachmat Syafe’i “Harmonization of Islamic Law and National Law can be seen in the formulation of the Marriage Law which was proposed since 1967 by the Government at that time to the Gotong Royong DPR, the submission of the bill again by the Government in 1973 until its ratification in 1974.” with one of the evidences of equalizing legal perceptions regarding the basis of marriage, polygamy and the principle of marriage, Muharramat marriage, the period of ‘Iddah, joint assets, divorce before the court, and other things that continue to develop.

According to Dr. Nurrohman, as a complement to the previous presenter, he added that the Compilation of Islamic Law is an unwritten form of law in Indonesia but is a source of law in courts and other Islamic-based institutions.

“KHI as an unwritten law can fill general law, especially filling legal voids for Indonesian citizens who are Muslim. (Attamimi, 1996: 155) As an unwritten law, the position of KHI is similar but slightly stronger than the books used in tradition. Islamic historical court.
